Assumption of Risk

Skiing, snowboarding and snow tubing have categories of inherent risks that all skiers/boarders/snow tubers MUST ASSUME if they participate in these sports.

The inherent risks include, but are not limited to: variations in weather, snow and terrain; ice, bare spots; collisions with other skiers/boarders/tubers and objects such as rocks and forest growth (above and below surface), towers, utility lines and their components and snowmaking and snow grooming equipment; falls; and skiing/boarding off an open trail. Any of these hazards can cause permanent catastrophic injury or death.

To enjoy skiing, boarding, and snow tubing, you must know and be willing to accept the limits of your ability.

Read and heed all posted signs.

Remember that it is your responsibility to always stay in control and to be able to stop or avoid collisions with other people and objects.

Not all objects, hazards, and conditions are marked, and you must exercise extra caution until you make yourself familiar with boundaries, obstacles and current conditions on all trails and in all areas where you will be skiing, boarding or tubing.

Where fencing and markers are used, you should be aware that these devices will not protect you from injury if you collide with them. If you cannot accept the inherent risks of these sports, please do not purchase a ticket at this area.

Pay attention to conditions and do not attempt to ski/board/tube on trails that are beyond your ability.

Know Your Responsibility Code and practice it for your own safety and for the safety of others.

Massanutten does not permit riding lifts or skiing, snowboarding or snow tubing with child carriers of any kind. All ski/snowboard equipment must have metal edges.

Chairlift rides for pedestrians and hikers are not offered during winter operations.

WARNING: Under Virginia law, there is no liability for an injury to or death of a participant in a project activity conducted at this location if such injury or death results from the inherent risks of the project activity. Inherent risks of project activities include, among others, risks of injury inherent to land, equipment and animals, as well as the potential for you to act in a negligent manner that may contribute to the injury or death. You are assuming the risk of participating in this project activity.
